WEBSITE OWNER AND BINDING OF TERMS
This website is owned and operated by UNITED SOULWAVES. These Terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers visitors Surf Lessons, Retreats and Surf Travels. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.
BOOKING CONFIRMATION
Bookings will become the binding contract between UNITED SOULWAVES and you, only when UNITED SOULWAVES sends you a Booking Confirmation.
PAYMENT AND PRICES
When booking a Surf Lesson or Surf Travel full payment is required by UNITED SOULWAVES. The prices printed on our website at the time of publication apply. UNITED SOULWAVES reserves the right to increase or decrease prices at any time after publication. At the time of booking, the price shown on the booking form applies.
INSTALLMENT PAYMENTS FOR RETREATS AND SURF TRAVELS
In certain circumstances we may offer payment in installments. The payment of the first installment secures your place. We will email you a payment plan and further details on payment methods. Failure to meet the payment schedule will result in us canceling your place. The full amount for the booked retreat or surf trip must be received by us no later than 90 days before the start of the Retreat or Surf Travel.
CANCELLATION POLICY
UNITED SOULWAVES requires payment of the full cost of Lessons, Retreats and Surf Travel at the time of booking and has the right to cancel a person's place on the activity or event if full payment has not been received, unless other payment terms have been agreed in advance and approved in writing by UNITED SOULWAVES. No payment reminders will be sent.
Tides, weather and sea conditions and other unforeseen events beyond UNITED SOULWAVES control may occasionally cause Surf Lesson times change. In case of changes, we will inform you by email or SMS before the lesson starts. In cases where changing lesson times is not possible, UNITED SOULWAVES will offer a choice of voucher credit. You agree to comply with all decisions and instructions made by our UNITED SOULWAVES Surf Coaches under their supervision. If participants do not follow the instructions of our staff and thereby endanger themselves or others, our UNITED SOULWAVES staff has the right to require the participant to leave the activity immediately and without any right to compensation.
Cancellation by Participant:
Should you need to cancel or change your booking, this must be done in writing by email or postal mail. A cancellation is deemed to have been received from the date of receipt by UNITED SOULWAVES.
Refunds for cancellations of Surf Lessons by the customer will be made as follows:
30 days or more from course start date = full refund
14 - 29 days before the start of the course = 50% refund
Less than 14 days to the start date of the course = no refund
Booking changes are possible up to 7 days before the surf lesson. Changes are no longer possible less than 7 days before the start.
UNITED SOULWAVES reserves the right to change course dates provided the course participants are notified.
Refunds for cancellations of Retreats and Surf Travels by the customer are made as follows:
90 days or more from Retreat or Surf Travel start date = 50% refund
Less than 90 days before the start of the course = no refund
Booking changes are possible up to 90 days before the event start. Changes are no longer possible less than 90 days before the start.
A termination of the stay or an earlier departure of the Retreat or Travel Participant does not oblige the UNITED SOULWAVES to reimburse services or partial services from the booking agreement. UNITED SOULWAVES is not obliged to sublet to third parties if the guest breaks up the event.
UNITED SOULWAVES reserves the right to cancel or change Retreat or Surf Travel dates provided the participants booked are notified whereby full refund will be given.
UNITED SOULWAVES will not issue any refunds or compensation if a course, Retreat or Surf holiday is canceled due to unforeseen circumstances beyond our reasonable control which could not have been avoided even if all due care had been exercised. This includes, but is not limited to, acts of terrorism or adverse weather conditions.
Cancellations by UNITED SOULWAVES:
In the event that UNITED SOULWAVES is compelled to cancel a travel offer due to unforeseen circumstances, insufficient participant numbers, or any other valid reason, the following terms will apply:
Notification and Alternatives: UNITED SOULWAVES will make all reasonable efforts to inform participants of the cancellation at the earliest possible time. Participants will be presented with alternative travel options, where applicable.
Refund Policy: Participants will be entitled to a full refund of all monies paid to UNITED SOULWAVES for the canceled travel offer where alternative travel options are not applicable. Refunds will be processed within 90 days from the date of cancellation
No Further Compensation: UNITED SOULWAVES shall not be liable for any additional compensation, consequential losses, or damages resulting from the cancellation beyond the refund of the amount paid for the canceled travel offer.
Force Majeure: UNITED SOULWAVES reserves the right to cancel a travel offer without liability in the event of circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, strikes, civil unrest, or government restrictions.
Participant Responsibilities: Participants are advised to consider UNITED SOULWAVES to mitigate potential financial losses in the event of cancellations. Participants are responsible for regularly checking communication channels for updates and announcements.
Rebooking Option: Participants are offered the option to rebook the same or a similar travel package at a future date with a discount or additional benefit as a gesture of goodwill.
Legal Compliance: This cancellation policy is subject to all applicable laws and regulations and may be amended as necessary to comply with changes in legislation.
REBOOKING POLICY
Flexibility in travel plans: We understand that our customers' travel plans may change. We therefore offer the option of rebooking free of charge if necessary.
Conditions for free rebooking: Free rebookings may be possible depending on availability and tariff conditions. The request for a free rebooking must be made within 90 days before the originally planned start of the Surf Holidays and 7 days before the originally planned start of Surf Lessons.
Alternative travel dates: Customers who wish to make use of a free rebooking have the option to choose alternative travel dates, if available.
Validity of the free rebooking: Free rebookings only apply to the same travel price or an equivalent tariff. The free rebooking is only possible once per original booking.
Process for free rebooking: To make use of the free rebooking option, please contact our customer service. Our employees will be happy to support you in selecting new travel dates and rebooking.
Restrictions and Availability: Free rebookings are subject to the seat availability and are subject to the fare rules of the new travel dates.
Flexibility Allowed: Through the free rebooking option, we aim to offer our customers the flexibility to adjust their travel plans to accommodate unforeseen circumstances.
A notice: We recommend that our customers contact us well in advance of their planned trip to check the best options for rebooking free of charge.
RESPONSIBILITY
UNITED SOULWAVES accepts no liability for personal injury, property damage or loss. We assume no responsibility or damage or claims by third parties that are not the fault of UNITED SOULWAVES employees, unless UNITED SOULWAVES can be proven to have acted negligently. In addition, by attending UNITED SOULWAVES Surf Lessons, you agree that you are participating at your own risk and confirm that you have your own insurance to cover loss or damage, or do not take out such insurance, although you understand that this is in is your own responsibility. You agree to declare any medical conditions or other special needs that may affect your safety or that of others while participating Surf Lessons and accept that UNITED SOULWAVES accepts no responsibility if your medical conditions are not disclosed. You accept no alcohol or consume drugs before or during surf lessons and agree that consumption of alcohol or drugs entitles UNITED SOULWAVES to refuse you participation in surf lessons.
EQUIPMENT LOSS OR DAMAGE
For surf coaching and rentals we use our UNITED SOULWAVES equipment. Damage to or loss of our equipment must be reported to us immediately. You agree that if the damage is repairable, you will pay for the repairs and if the damage is irreparable or the equipment is lost, you will replace it at replacement value. We allow you to use your own equipment after prior consultation with our employee or notice in the booking form. You agree that when using your own equipment, claims for damages are not applicable if the damage is not due to the fault of our employees.
MEDICAL CONDITIONS AND SAFETY
Participation in our Courses, Retreats and Surf Travels requires that you are medically suitable for participation. Make sure you have any necessary medication or medical equipment that you will need during the course. You agree that participating in Retreats and Surf Travels will, if we require you, undergo a full medical examination and provide a medical certificate (at your own expense) at the time of payment of the final bill certifying this medical examination.
You accept that there is a risk of injury in the Sports we offer for coaching and you agree that UNITED SOULWAVES will not be liable for any injury or damage you suffer if you willingly took a risk and the injury or damage was not caused by our negligence are. It is your right to refuse to take any risk that you believe could endanger your health or safety
For Surf Travels and Retreats we recommend that you seek medical advice in relation to the country you are traveling to and you understand that it is your responsibility to seek medical advice in relation to any visit to the country. UNITED SOULWAVES does not provide medical advice. Make sure that medication or vaccinations are obtained in your home country in good time before you travel. UNITED SOULWAVES accepts no liability for any medical condition arising from your failure to seek such medical advice.
DESTINATIONS SPECIFIC DANGERS
We cannot be held responsible for these activities or the dangers to which you as a customer may be exposed. However, we only choose locations for our Surf Travels that have a low risk of these dangers. We do our best in risk assessment to determine the level of risk that each hazard poses based on the combination of the likelihood of such a hazard occurring and the severity of the outcome. However, we cannot rule out the possibility of such dangers occurring. When booking our Retreats or Surf Travels, you agree to the risks and that you act on your own responsibly and carefully in dealing with any site-specific hazards.
IMAGE RIGHTS AND SURF FOOTAGE
UNITED SOULWAVES reserves the right to use any photographs, film taken of you during your courses, Surf Travels and Retreats solely for the purpose of corporate marketing or promotional materials.
If you have booked a surf video package, UNITED SOULWAVES will endeavor to provide you with an edited film within 1 week, which you can download from our website in the members' area and receive an e-mail with a link to the download gallery. After receiving the download link, the download is available for 7 days. If you have not received any download links within the time frame, it is your responsibility to contact UNITED SOULWAVES immediately as the video material will be deleted after 10 days. It can happen that the cameras we use fail during the activity. Should this occur, a credit will be issued to you or a new surf video session arranged.
PERSONAL DATA
The contact details of the participant in our courses are entered into the UNITED SOULWAVES database and stored in accordance with the GDPR 2018. This information is never shared with third parties and is never passed on for third party advertising purposes.
In order to offer you surf trips and retreats, we need to collect certain information such as your name and address, medical information, passport number. We may share this information with hotels and transport companies booked for the event. We may share this information with public authorities such as customs and immigration, where necessary. With your booking, you agree that this information will be passed on to the appropriate third parties required for Surf Travels and Retreats.
